End User License Agreement (EULA) for Demo Use of Gas Cylinder Inventory Management Software

1. Introduction:

This End User License Agreement ("Agreement") is a legally binding contract between you ("User") and Rishabh Software Private Limited ("RSPL") for the use of the Gas Cylinder Inventory Management Software ("Software") in its demo version. This Software is offered exclusively for testing, evaluation, and feedback purposes. By downloading, accessing, or using the Software, you agree to adhere to the terms outlined herein.

2. License Grant:

RSPL hereby grants you a limited, non-exclusive, revocable, and non-transferable license to use the Software solely for demonstration and testing purposes. You may evaluate the functionality and features of the Software but may not use it for commercial activities, production environments, or any other unauthorized purposes.

3. Demo Period:

The Software is provided free of charge for a limited demo period of 2 Months. RSPL may modify or terminate the demo period at any time without prior notice.

4. Disclaimer of Warranties:

THE SOFTWARE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED. RSPL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• ( a ) MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• ( b ) ACCURACY, RELIABILITY, AND PERFORMANCE
• ( c ) NON-INFRINGEMENT OF THIRD-PARTY RIGHTS

You acknowledge that the Software may contain bugs, errors, or interruptions, and RSPL has no obligation to provide maintenance, updates, or fixes during the demo period. RSPL may, from time to time, release updates, patches, or beta features for the Software. Such releases are provided “as is” and may include experimental or unstable functionalities. RSPL makes no guarantee of compatibility or performance and reserves the right to modify or remove features without notice.

5. Safety Disclaimer:

This Software is intended only as a digital management and tracking aid for gas cylinder inventory. It does not replace proper safety procedures, monitoring, or compliance obligations applicable under law or industry standards. Users remain solely responsible for ensuring adherence to all safety and regulatory requirements.

6. Data Accuracy Disclaimer:

RSPL does not warrant that the data recorded, generated, or processed by the Software is accurate, complete, or free from error. The accuracy of cylinder quantities, test dates, pressure ratings, or maintenance information depends entirely on the data input by the User. RSPL assumes no responsibility for losses, accidents, or penalties arising from erroneous data entries, configuration errors, or system misinterpretation.

7. Data Storage:

The Software may temporarily store data locally on the User’s device or in a cloud environment. RSPL is not responsible for loss, corruption, or deletion of data during or after the demo period. Users are advised to maintain independent backups of all data entered into the Software.

8. Limitation of Liability:

To the maximum extent permitted by law, RSPL shall not be liable for any claims, damages, or losses arising out of or relating to the use of the Software, including but not limited to:

• ( a ) Direct, indirect, incidental, consequential, or punitive damages
• ( b ) Data corruption, loss of profits, or business interruption
• ( c ) Failures, errors, or inaccuracies in the Software
• ( d ) Non-compliance with any law including without limitation GDPR, CCPA or any other similar law outside the territory of India.

You assume all risks and responsibilities associated with using the Software.

9. Usage Restrictions:

You agree not to:

• ( a ) Copy, modify, reverse-engineer, disassemble, or decompile the Software
• ( b ) Distribute, sublicense, lease, or transfer the Software to any third party
• ( c ) Use the Software for illegal, unauthorized, or commercial purposes
• ( d ) Remove or obscure any copyright notices, trademarks, or proprietary marks from the Software.

10. Feedback:

You may provide suggestions, bug reports, or feedback about the Software to RSPL. All such feedback shall become the exclusive property of RSPL, who may use, modify, or incorporate it into future versions of the Software without compensation to you.

11. Termination:

RSPL may terminate this Agreement at any time, without notice, if you fail to comply with any of the terms herein. Upon termination

• You must immediately stop using the Software
• ( a ) All copies of the Software in your possession must be deleted or destroyed.

12. Ownership and Intellectual Property:

The Software and all associated intellectual property rights remain the exclusive property of RSPL. This Agreement does not transfer any ownership, title, or rights to the User.

13. Indemnification:

You agree to indemnify and hold harmless RSPL, its affiliates, and employees from any claims, damages, or expenses (including legal fees) arising from

• ( a ) Your use of the Software
• ( b ) Violation of this Agreement
• ( c ) Any misuse or unauthorized access to the Software.

14. Governing Law:

This Agreement shall be governed and construed in accordance with the laws of the Union of India. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts at Vadodara.

15. Entire Agreement:

This Agreement constitutes the entire understanding between you and the Developer regarding the use of the Software. Any previous agreements, oral or written, are superseded by this Agreement.

16. Acknowledgment:

By accessing, downloading, or using the Software, you acknowledge that you have read, understood, and agreed to the terms of this Agreement.
